terms of service To be an authorized affiliate of www.k9kloud.com, you agree to abide by the terms and conditions contained in this agreement. By filling out the signup form you acknowledge that you have read the terms and conditions, understand, and agree with them. 1. JOINING THE K9 KLOUD9 AFFILIATE PROGRAM By filling out the signup form you will automatically become an affiliate of K9 Kloud9 Creations (\K9 Kloud9\ and \K9Kloud9.com\) and are bound by the terms of this agreement. Your participation in the program is solely for this purpose: to legally advertise our website to receive a commission on products purchased by your referral individuals. 2. REVOCATION OF AFFILIATE STATUS Your affiliate application and status in the program may be suspended or terminated, without prior notice, at any time, for any of the following reasons: Inappropriate advertisements (False claims, misleading hyperlinks) Spamming (mass email, mass newsgroup posting, etc...) Advertising on sites containing/promoting illegal activities or site that contain gambling, pornography or advertisements for prescription drugs. Violation of intellectual property rights. 3. AFFILIATE LINKS You may use graphics and text links both on your website and in emails as provided K9Kloud9.com. You may also create your own banner as long as they are deemed appropriate according to the conditions in 2. In the event that you create your own banner advertisement, text or graphic, it must be preapproved by K9 Kloud9, prior to becoming �active.� 4. TRACKING AND COMPENSATION K9 Kloud9 Creations will pay you a referral fee for any product sale referred by you and your unique identifying link. Specifically, when a visitor at your website clicks on your unique link / graphic taking them to the K9Kloud9.com website, adds a purchase to the shopping cart and completes the online order process, a referral fee has been earned. The referral fee paid is 20% of the product purchase price before shipping and taxes are applied. Fees are paid in US funds by either check or paypal on a monthly basis, on the 15th of each month, and based on your total referred sales from the previous month. You may elect to have your commissions donated to a charity of your choice. In order to process this, please ensure that the details of the desired chairty are provided to K9Kloud9.com. No referral fees are paid on returned products; if any of your referral sales result in a refund after you have already been paid a referral fee, then this referral fee amount is deducted from your next referral payment. We will track your referral sales through your unique links and make online reports available for you to monitor your activity and earnings. You may not order products initiated through your unique links to the K9Kloud9.com website for your own personal use or on behalf of someone else, for resale, or for commercial use of any kind. K9 Kloud9 reserves the right to withhold referral fees on these prohibited sales, and/or terminate this agreement. We reserve the right to maintain or change our current pricing of products. Customers who buy products through affiliate links are deemed to be our customers, and all of our rules, procedures, privacy and operating policies regarding customer service and product sales will apply to those customers. K9 Kloud9 assumes no liability for personal injury due to product abuse, mishandling, or negligence. K9 Kloud9 will process all orders initiated through your unique link to our website. Order processing includes payment processing, shipment preparation and mailing, customer notification of shipment, and handling returns, cancellations and other customer service issues. 5. TERMS & CONDITIONS The term of this agreement commences upon your acceptance of this agreement application and ends when terminated by either party at any time, for any reason. K9 Kloud9 reserves the right to modify the terms and conditions of this agreement at any time, by posting the modified agreement on the K9Kloud9.com website. Once this agreement is terminated, you agree to promptly remove all links and content associated with the K9 Kloud9 Affiliate Program and its products from your website and advertisements. You will be entitled to any referral fees earned prior to the termination. 6. LIABILITY Under no circumstance, will K9 Kloud9 Creations be held liable for indirect or accidental damages (loss of revenue, commissions) due to affiliate tracking failures, loss of database files, and any results of \intents of harm\ to the program or our website. We do not make any expressed or implied warranties with respect to the affiliate program and/or products sold at this site. We make no claim that the operation of the affiliate program or our website will be error-free and are not be liable for any interruptions or errors. Any arbitration or dispute arising from this agreement will be handled by the appropriate governmental agency in the province of British Columbia, Canada. By registering to participate in the K9 Kloud9 Affiliate Program, you agree to be bound by the terms and conditions of this agreement and by any modifications to this agreement that may be made, from time to time.
